cMail eXpress by BiBa SOFTWARELICENSE AGREEMENT AND LIMITED WARRANTYThis Software is shareware, which you may evaluate for 30 days. At the end of the thirty days you must either buy a license from BiBa SOFTWARE, or remove the Software from your computer(s) and stop using it.Who is allowed to use Software Free of Charge:You are allowed a non-exclusive, limited license to use the Software free of charge if you are evaluating the Software for a maximum of 30-days (as per the above paragraph).CopyrightThe Software is owned by BiBa SOFTWARE and is protected by Canadian copyright laws and international treaty provisions.You must treat the Software like any other copyrighted material. Therefore you must treat this Software just like a book, whereby no two persons can concurrently use a single license for the Software at the same time. This means that you can use a single license on two or more computers as long as only one person has use of the program. You may not charge or receive any consideration from any other person for the receipt or use of the Software without receiving BiBa SOFTWAREs prior written consent.If you wish to include the Software as part of a shareware compilation, please contact BiBa SOFTWARE for written consent.You may not: modify, translate, disassemble, decompile, reverse engineer, or create derivative works based upon the Software.You may store one or more copies of the software offline, on secondary storage media (i.e. CD-ROM, diskette) for backup purposes.You agree to use your best efforts to see that any user of the Software licensed hereunder complies with this Agreement.Disclaimer of WarrantyThis software is provided AS IS, without warranty of any kind.The entire and exclusive liability and remedy for breach of this limited warranty shall be limited to replacement of defective media and shall not include or extend to any claim for or right to recover any other damages, including but not limited to, loss of profit, data, or use of the software or special, incidental or consequential damages, or other similar claims, even if BiBa SOFTWARE has been specifically advised of the possibility of such damages.In no event will BiBa SOFTWAREs liability for any damages to you or any other person ever exceed the lower of the list price or the actual price paid for the license to use the software, regardless of the form of the claim.BIBA SOFTWARE SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, REPRESENTATIONS, OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OR CONDITION OF MECHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
